The Position of Genetic Resources and Potential Geographical Indications in The Legal Protection of Communal Coffee
Isi Artikel Utama
Abstrak
This study examines the position of Genetic Resources and Potential Geographical Indications as legal protection instruments for communal coffee in Indonesia. The study employs a normative legal research method using statutory and conceptual approaches. The findings show that coffee commodities may be recorded as either Genetic Resources or Potential Geographical Indications. However, the distinction lies in the aspects protected and the objectives of such protection. Genetic Resources focus on the biological value and genetic information of coffee, as well as the prevention of biopiracy, whereas Potential Geographical Indications serve as an initial inventory of products possessing particular characteristics, reputation and a connection to a specific geographical area as a preliminary step toward Geographical Indication protection.
