Abstract

Inheritance disputes often occur due to unilateral control over inherited property, so that the application for bail confiscation is submitted as a preventive measure in the Religious Court. This research examines the legal basis and implementation of bail confiscation in inheritance cases at the Klaten Religious Court through a study of Decision Number 0219/Pdt.G/2024/PA.Klt. As a result, the application was rejected because the object of inheritance was not controlled by the defendant and the evidence did not support it. It was concluded that the submission of a security seizure must be accompanied by strong evidence, as well as the need for technical guidelines to ensure legal certainty for the parties.
