Abstract

This study examines the resolution and legalization of former railway land occupied by residents in Sumberharjo Village, Wonogiri. The research highlights the tension between legal certainty in managing state assets by PT KAI and social justice claims of communities who have lived on the land for decades. A juridicalempirical, qualitative descriptive approach is applied through in-depth interviews with BPN officials, PT KAI representatives, village authorities, and residents. Findings underline overlapping physical occupation and legal ownership, the central role of mediation among stakeholders, and the need to balance legal certainty with substantive justice using John Rawls’ Justice as Fairness.
