The Impact of Notarial Inaccuracy in Creating Lease Agreement Deeds Regarding Lease Terms Exceeding the Duration of Management Rights Agreement (Review Based on the Notary Position Law)

Abstract
Notaries are authorized to create authentic deeds for agreements required or desired by the parties, including lease agreements. This normative juridical research analyzes the legal regulation of lease agreements in authentic deeds based on the Civil Code (Articles 1320, 1548-1600) and Law No. 2 of 2014 concerning Notary Position, notaries' obligations in applying legal provisions, and the legal impact of notarial inaccuracy in setting lease terms exceeding the validity period of management rights. Research findings indicate such inaccuracy significantly impacts deed validity and legal certainty, thus recommending strengthened prudential principles through strict land document verification and enhanced supervision by the Supervisory Council.
