Abstract

The sale and purchase of land as collateral object with violations of deed procedures raises complex legal issues regarding legal certainty and justice. This normative juridical research analyzes the regulation of land rights transfer through sale and purchase deeds based on UUPA and PP No. 24/1997, unlawful acts in property transfer according to Article 1365 of the Civil Code, and Supreme Court Decision No. 47 PK/Pdt/2025 which annulled the sale and purchase deed due to procedural violations. The results show the decision is problematic as it fails to consider the position of good faith buyers, proportionality of legal consequences of procedural violations, and notary liability along with compensation mechanisms for aggrieved parties.
