Abstract

The creation of a deed of division of joint rights terminates joint ownership of land, transferring it to the respective rights holders. Furthermore, it can serve as evidence that a legal act has occurred between the holders regarding the division of joint rights. This paper uses a normative (literature) research method with qualitative analysis to conclude that an unlawful act has occurred under Decision Number 218/Pdt.G/2024/PN.Blb based on the control of joint rights by several heirs through the occupation and construction of the joint rights object for which a deed of division of joint rights has been drawn up. Ultimately, the distribution of joint assets under Decision Number 218/Pdt.G/2024/PN.Blb is returned to the Plaintiff as the rightful owner based on the deed of division of joint rights, followed by a change of name.
