Abstract
The development of technology in society is so rapid that it integrates closely with social activities, making public access to information easy and fast. Rapid access to information also creates a potential for false news or hoaxes, which has been regulated under Law No. 1 of 2024. However, an issue arises in Article 28 paragraph (3) regarding the term 'riot,' which shares the same basis as the term 'disturbance' in Constitutional Court Decision No. 78/PUU-XXI/2023. Both terms, 'disturbance' and 'riot,' possess similar characteristics in that they are not singular. This study will employ a normative legal research method by examining the term 'riot' using legal materials such as primary legal sources and legal literature related to the research topic, aiming to interpret the meaning of 'riot.' Therefore, it is necessary to formulate the definition of 'riot' to provide legal certainty with a clear explanation of the term 'riot.'so that the understanding of the word “riot” is not trapped in the interpretation of the word “disturbance” which has been declared unconstitutional, thereby providing legal certainty based on the 1945 Constitution regarding freedom of expression.
