Abstract

The procedure for issuing a Certificate of Inheritance (SKW) at the sub-district or court level does not include verification of the existence of a will, resulting in heirs often being unaware of any testament made by the deceased. The absence of an obligation to disclose a will increases potential disputes. This normative legal research, using statutory and conceptual approaches, concludes that inheritance determinations may change upon discovery of a valid will pursuant to Article 874 of the Civil Code.
