Legal Consequences For Notaries As Intermediaries In Money Transfer In Embezzlement Cases A Study Of Decision Number 1379 K/Pid/2023

Abstract

The phenomenon of notaries acting as intermediaries in money transfers for land sale transactions is analyzed through normative juridical methods and a case study of Decision Number 1379 K/PID/2023. The Notary Position Law does not provide attributive authority for notaries to act as fund intermediaries, placing such actions outside职ional protection. Although notaries may be subject to sanctions under Article 372 of the Criminal Code if intent is proven, analysis of the decision shows that the notary's conduct is more appropriately classified as negligence within civil and administrative domains, rather than criminal complicity. Law enforcement should prioritize administrative sanctions and civil compensation mechanisms.
