Personal Data Protection In The Use Of Smart Contracts In Indonesia
Main Article Content
Abstract
Blockchain’s development has given rise to smart contracts that execute agreements automatically, transparently and efficiently, but at the same time it creates personal data protection issues because of their permanent, immutable and decentralized nature. This study aims to analyze the legal framework, implementation challenges and the ideal form of legal protection for smart contract users in Indonesia. Using a normative juridical method with statutory and conceptual approaches, this descriptive-analytical study is based on secondary data. The results show that legal protection is currently grounded in the PDP Law, the ITE Law and the Civil Code, yet no specific regulation has been established. Therefore, a lex specialis, Privacy by Design and stronger supervisory institutions are needed. These efforts are expected to guarantee legal certainty while balancing blockchain technological innovation with the fulfillment of users' privacy rights.
