Identification Of Bioethical Issues In Biogenomic Projects From The Perspective Of Health Law In Indonesia

Abstract

Biogenomics has advanced rapidly in the healthcare sector, yet its management raises new ethical concerns. This study employs a literature review approach to identify key ethical issues regarding biogenomics development in Indonesia, viewed through the lens of the underlying legal framework. Sources were drawn from prevailing Indonesian legislation, particularly regarding ethical issues in biogenomic services. Five key issues were identified: data protection, informed consent, benefit-sharing, genetic discrimination and the security of cross-border data transfer. The national legal framework remains fragmented across laws on health, personal data protection and regulations concerning medical records, research and biomedical institutions, yet it has not yet addressed genomic data in an integrated manner. Recommendations are offered to the government to formulate regulations governing the development of biogenomics.
