The Implications Of Age Restrictions On The Civil Rights Of Prospective Workers In The Employee Recruitment Process In Balikpapan City
Main Article Content
Abstract
This study aims to analyze the impact of Constitutional Court Decision No. 35/PUU-XXII/2024 on age discrimination practices in labor recruitment, as well as to examine the protection of workers' civil rights against such practices. The research employs a socio-legal method combining normative and empirical analysis through field studies in the City of Balikpapan. The findings indicate that the Constitutional Court's decision legitimizes age restrictions imposed by employers, yet in practice many job vacancies specify age limits without objective justification relevant to job requirements. From a civil law perspective, this practice contradicts the principle of equality and the civil rights of individuals as legal subjects within pre-employment relations.
