Abstract

The annulment of a marriage agreement has legal consequences for the husband and wife, as well as for the assets brought into and acquired during the marriage. This study analyzes the judge’s legal considerations in the annulment of a marriage agreement in a mixed marriage based on South Jakarta District Court Decision Number 526/PDT/G/2012/PN.Jkt.Sel. The Panel of Judges declared the marriage agreement null and void based on the applicable legal provisions and evidence submitted by the parties. However, following Constitutional Court Decision Number 69/PUU-XIII/2015, these legal considerations can no longer be fully applied due to changes in the provisions governing marriage agreements.
