Abstract
Joint property disputes reveal a gap between normative guarantees and evidentiary practice in court. This study analyzes legal protection for wives’ rights and the judges’ reasoning in Batam District Court Decision Number 323/Pdt.G/2021/PN Btm. It applies normative legal research with statutory, conceptual and case approaches. The study finds that the Civil Code and Marriage Law establish equal legal positions, while concrete protection remains dependent on proof. The decision upholds legal certainty and the burden of proof, but does not fully reflect substantive justice for the wife’s non-economic contributions.
