Abstract

This study examines the relevance of inconsistent testimony by Land Deed Officials (PPAT) in court proceedings to the evidentiary strength of Sale and Purchase Deeds (AJB) as authentic deeds. This normative juridical research employs statutory, conceptual, and case approaches by analyzing the Madiun District Court Decision Number 97/Pid.B/2021/PN Mad. The findings indicate that inconsistent testimony by a PPAT does not automatically deprive an AJB of its authentic status or evidentiary strength. However, such inconsistency may be considered when assessing the credibility of the PPAT’s testimony and the process by which the deed was executed. Its relevance depends on whether the inconsistency is connected with other evidence indicating compliance with, or defects in, the formal requirements for executing the deed. Accordingly, the evidentiary strength of an AJB must be assessed in accordance with applicable law and all relevant evidence, rather than on the inconsistency of the PPAT’s testimony alone.
