The Application Of Digital Evidence Under Law Number 20 Of 2025 Concerning The Criminal Procedure Code

Abstract

Advancements in information technology have made the proof of criminal offenses increasingly reliant on digital evidence. The enactment of Law Number 20 of 2025 concerning the Criminal Procedure Code (KUHAP) established a legal basis by recognizing electronic evidence as a valid form of evidence. This study aims to analyze the legal status of digital evidence, the readiness of the Cyber Unit of the Jember Resort Police Criminal Investigation Division and the factors facilitating or hindering its implementation. The study employs a socio-legal method, utilizing both statutory and factual approaches. The findings indicate that Article 235 paragraph (1) of the 2025 KUHAP provides legal certainty regarding digital evidence. However, its implementation remains constrained by limitations in human resources, digital forensic facilities and technical regulations within law enforcement practice.
