Abstract

The legal status of land possession after a sale and purchase involving unlawful acts is determined by the existence or non-existence of a valid legal basis over the land. Legal protection for the lawful landowner is provided through recognition of the Certificate of Ownership (Sertifikat Hak Milik) and the Deed of Sale and Purchase (Akta Jual Beli) executed in accordance with legal provisions. In Decision No. 2562 K/Pdt/2024, the Supreme Court held that Deed of Sale and Purchase No. 08 of 2013 constituted a valid basis for the transfer of rights, so that the party possessing the land without legal basis lost legitimacy and was obliged to vacate and hand over the disputed object to the lawful owner.
