Legal Analysis Of Unregistered Karo Customary Marriage “Tanganan Raja” Under Law Number 1 Of 1974 On Marriage A Study In Katepul Village, Kabanjahe District, Karo Regency
Main Article Content
Abstract
The Karo customary marriage known as tanganan raja in Katepul Village is examined regarding its implementation, nonregistration, legal standing, consequences and remedies. This empirical juridical research employs interviews, literature review and qualitative analysis. Findings indicate that customary procedures involve pengulu kuta and rakut sitelu. Nonregistration stems from customary legitimacy, administrative barriers, age restrictions and bureaucratic perceptions. This creates uncertainty concerning wives’ rights, children’s status and marital property. Legal protection may be pursued through court petitions, proof of biological parentage under Constitutional Court Decision Number 46/PUU-VIII/2010 and property claims under applicable law to safeguard the interests of spouses and their children.
