Ree Will As A Valid Requirement For Marriage In Law Number 1 Of 1974 Concerning Marriage And The Compilation Of Islamic Law -
Main Article Content
Abstract
Everyone has the right to choose a life partner freely. Marriage without free will can cause legal problems. This study analyzes Law No. 1 of 1974 and the Compilation of Islamic Law (KHI) using a normative juridical method. It examines the regulation of free will in marriage and the legal consequences of forced marriages. The results show that free will is a fundamental legal requirement in marriage, but it is often ignored in practice, leading to legal issues such as marriage annulment. Therefore, marital consent must be given freely to avoid future legal problems.
