Abstract
The study of the misuse of artificial intelligence (AI) in indecent content and defamation is a crucial issue in digital criminal law in Indonesia. This study aims to analyze Indonesia's criminal law regulations in responding to AI misuse and to formulate a more adaptive and equitable legal reconstruction. It uses a normative legal research method through a legislative, conceptual and doctrinal approach. The results of the discussion show that Indonesian positive law still contains normative gaps, both in terms of sanctions that are still oriented towards imprisonment, limitations on digital victim recovery and the absence of preventive AI technology control mechanisms, particularly in the provisions of the ITE Law.
