Protection Of Workers' Rights In Coffee Shop Businesses Under Oral Employment Agreements In Kendari City
Main Article Content
Abstract
This study examines the protection of workers' rights in coffee shops operating on the basis of oral agreements in Kendari City. The research problem stems from the practice of employment agreements made without written documentation, which complicates the evidentiary process in the event of a dispute. This study employs a combined normative-empirical legal research method using statutory and conceptual approaches, analyzing the application of law based on facts and empirical conditions within society. The results indicate that oral employment agreements remain valid and legally binding, provided they fulfill the essential elements of a valid contract and comply with prevailing labor regulations. Workers retain statutory rights that employers are obligated to fulfill; however, written agreements are necessary to provide legal certainty and facilitate the determination of the rights and obligations of the parties involved. Therefore, enhanced labor inspection and increased legal awareness among both workers and employers are required to ensure the optimal fulfillment of workers' rights.
