Abstract

Children born out of wedlock frequently face discrimination in the recognition of their inheritance rights. Despite the Constitutional Court Decision No. 46/PUU-VIII/2010, the implementation of the law and prevailing social stigma continue to obstruct their access to equal inheritance rights. The Certificate of Inheritance can serve to strengthen the legal standing of children born out of wedlock. However, further inclusive legal reforms within the Civil Code, along with efforts to raise public awareness, are essential to ensure that children born out of wedlock can obtain their rights fairly.
